The U.S. Department of Education (Department) today released its Final Rule under Title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex in education programs or activities receiving Federal financial assistance.
The final regulations promote educational equity and opportunity for students across the country by restoring and strengthening vital protections for students, and provide schools with information to meet their Title IX obligations while offering appropriate discretion and flexibility to account for variations in school size, student populations, and administrative structures. The final regulations also promote accountability by requiring schools to take prompt and effective action when notified of conduct that reasonably may constitute sex discrimination in their education programs or activities. The final regulations also reaffirm the Department's core commitment to fundamental fairness for all parties, the rights of parents and guardians to support their minor children, and respect for complainants' autonomy.
In addition to the Final Rule, the Department has released a fact sheet, a summary of the major provisions of the final regulations, and a resource for drafting Title IX nondiscrimination policies, notices of nondiscrimination, and grievance procedures. The Final Rule will be effective on August 1, 2024, and apply to complaints of sex discrimination regarding alleged conduct that occurs on or after that date. The Department is committed to supporting schools in implementing the final regulations and will provide technical assistance and additional resources to schools to support implementation and compliance.

Learn What to Expect From the New Rules with my 30-minute NPRM Refresher Video
You are not imagining things if it feels like just yesterday that the administration completely overhauled the Title IX Rules, establishing new requirements and expectations for schools in combatting sex-based discrimination.
In 2020, re-written Title IX regulations took effect with numerous mandates including specific training requirements and a whole set of prescriptive processes schools must follow in implementing thier non-discrimination policies and procedures.
After the most recent presidential election, the Biden administration announced it would, again, be re-writting the rules and in 2022, these proposed rules were published via an NPMR (Notice of Proposed Rulemaking). Late last year, the Department of Education promised Final Rules in May of 2023, and on May 26, the Friday before the long Memorial Day weekend, ED published an update to its regulatory timeline, pushing back publication of the Final Rule to October 2023. October has come and gone and we now look forward to March 2024 as the next targeted release date. Only time will tell....
What does that mean for you? Adhere to current rules, but be prepared for changes in the coming months.
First, current rules must be followed (the old "new" rules from 2020). These rules remain in full force and effect until the new, "new" rules become effective. While we expect from recent announcements that these new rules are likely to be released in Spring 2024, we don't know what the effective dates will be for various provisions until they are released. This means you must continue to meet mandated training requirements, adhere to the various due process protections baked into the current rules, including those requiring live hearings and cross-examination, in the postsecondary setting.
T9Now is gearing up now to offer comprehensive training on the new rules which will be rolled out after their release on our new learning management platform. In the meantime current on-demand training is available for new Title IX officials or those needing a refresher in the interim.
Jumpstart your Title IX compliance with our comprehensive deep dive into the new 2024 regulations. This live 4-hour training will guide you through the essentials and offer practical strategies for operationalizing the new requirements to ensure compliance by the August 1, 2024 deadline.
